As uncomplicated as it is, Curacao gambling license still comes with a small limitation regarding target markets. Depending on the master license holder, Curacao licensees are not allowed to accept players from a list of countries including USA, France, the Netherlands, Singapore and Curacao itself. In addition, it is strongly recommended not to accept players from Australia.
Curacao regulator does not clearly define the requirement to limit access for players coming from jurisdictions in which online gambling is prohibited. This aspect makes it different from, for example, i-gaming license of the Isle of Man, under which, the operator must submit legal opinions from every jurisdiction in which they are planning to operate, confirming the fact that providing online gambling services there is not against the law.
Evaluating the jurisdictions in which the gambling services can be provided under the Curacao online gaming license, it is important not to overlook the aspect of payment service providers. Some of them might request the operator to provide legal opinions from particular jurisdictions, even if the regulator does not have such requirement.
Operating in prohibited jurisdictions exposes operators to a number of possible issues: penalties from regulators of specific countries, negative public information, reputational issues, loss of payment service providers, loss of license, declining relations with partners and other stakeholders, etc.
Currently, Curacao is reviewing and updating its i-gaming licensing policies. These actions were taken after the Netherlands raised several conditions, one of which involved financial support during the COVID-19 pandemic. Specialists at Nomad Law are constantly monitoring the situation in order to make sure that our customers never miss the latest developments and the services we provide are always up-to-date with the latest changes in the regulatory environment.
